Preface

  • To protect national unity, integrity, and sovereignty,
  • Keeping harmony and equality towards all religions, cooperating among all religions, being committed to the recognition of complete religious freedom, and having faith in the recognition of Sanatan Hindu Rashtra, to promote the Sanatan Dharma culture, values ​​and traditions that have been passed down from tradition.
  • To strengthen inclusive democracy based on pluralism,
  • To implement the concept of rule of law based on the independent and impartial judiciary
  • To contribute to building a strong and prosperous Nepal on the ground of a liberal economy based on the principle of social justice and equality
  • Realizing the need for a common organization of the nationalist Nepali people, this legislation has been prepared to make the establishment, operation, and management of the “National Democracy Party Nepal” democratic, inclusive, clean, reliable and transparent.

Paragraph-1

Initial

1. Party Name and Commencement: (1) The name of this legislation shall be “National Democratic Party of Nepal Legislation 2078”.
(2) This statute shall come into effect from the date of its passing by the Central Working Committee of the Party.

2. Definition: In this Act, unless the context or context otherwise requires:
(a) “Assembly” shall mean the assembly capable of exercising the rights according to the statute, including the election of the relevant level of the party held at the province, district, village/city and ward level as mentioned in the various articles of this statute.
(b) “Commission” means the Election Commission constituted under Article 245 of the Constitution.
(c) “Relevant Office of the Commission” shall mean the concerned District Election Office in case of Ward, Village/Town and District Committee, the concerned State Election Office in case of State Committee and the Election Commission Central Office in case of Central Committee.
(d) “Act” means the Political Parties Act, 2073.
(e) “Committee” means Central, State, District, Village/Town, Ward Working Committee. And this word will also refer to the various committees of the party.
(f) “Executive authority” means the authority conferred by statute to make decisions on behalf of the parties.
(g) “Central Working Committee” means the Executive Committee of the Party constituted and mobilized at the Central level.
(h) “Central body” means the executive committee and other committees formed and operational at the central level.
(i) “Fund” means the Fund of the Party.
(j) “As prescribed” shall mean as prescribed in the regulations made by the party governed by this statute.
(k) “Party/Party” means “National Democratic Party of Nepal”.
(l) “Municipality” means municipality, sub-metropolitan municipality and metropolitan municipality as well.
(d) “Officer” means all the members including the chairman, coordinator of the committee elected or formed in accordance with this statute. The term also refers to a representative appointed to represent a party in a body for a specific function.
(d) “Municipality” means rural municipality and municipality.
(n) “Province Committee” means the executive committee of the party formed and mobilized at the provincial level.
(p) “Principal Officer” shall mean the Chairman or the Chief Minister and the term shall also refer to the Chairman/Convenor and Secretary of the Department or other Committee.
(h) “Provincial body” means other committees including the executive committee formed and operating at the provincial level.
(d) “Convention” means the assembly which is organized at the central level and is able to exercise the powers according to the law, including the election of the central level committee, amendment of the statute.
(d) “Higher Committee” means village/town committee in case of ward level committee, village/town committee/committee, district committee/committee, state committee/committee in case of district committee/committee, central committee/committee in case of state committee/committee. should
(N) “Statute” means the Statute 2078 of the “National Democratic Party of Nepal”.
(p) “Member” means a person who is a member of the Party.
(f) “Assembly/Council” means the Assembly/Council competent to exercise powers under the Act.
(b) “Inclusive group” means women, dalits, tribals, Khas Aryas, Madhesi, Tharu, Muslims, backward areas, persons with disabilities, youth and other categories, areas and communities specified in the rules of the party.
(b) “Parliamentary Party” means the mechanism of the party formed in the federal or state level parliament by including the members who represent the party in the federal parliament or state assembly.
(m) “Mechanism” means the various bodies of the party which are formed and mobilized from the center to the local level for the operation of the party.
(y) “Constitution” means the Constitution of Nepal.
(r) “Associated Organizations” shall mean professional and professional brother and sister organizations of all levels formed while committed to the principles of the Party.

Paragraph-2

Arrangements regarding party name and office

3. Name and Office of the Party:

(1) The name of this party shall be “Rashtriya Prajatantra Party Nepal” and shall be briefly referred to as “RPPA Nepal”. In English language it will be called Rastriya Prajatantra Party Nepal and in short it will be called RPP Nepal.
(2) The central office of the party will be located in Ward No. 4, Kathmandu Metropolitan City, Kathmandu District.
(3) The party shall establish and operate provincial and local offices in each province and local level for the operation and management of its programs in accordance with this statute.

4. Party shall be a self-governing and organized body: (1) RPP Nepal shall be a self-governing organized body with unbroken succession.
(2) The party may acquire, enjoy, sell or otherwise manage movable or immovable property like a person under the law.
(3) A party may file a complaint in its own name and a party may file a complaint in the same name.
(4) A party may enter into an agreement with a person subject to the Act and exercise rights or perform obligations under the agreement.

Paragraph-3

Party seal, insignia, and flag5. Seal of the Party: The party shall have a separate seal as per schedule-1 for its work.

6. Party symbol: The party symbol will be as provided in schedule 2.
7. Flag: The flag of the party shall be as prescribed in Schedule 3.
8. Party manifesto: (1) The party shall have its own manifesto.
(2) A party may amend its manifesto as necessary.

Paragraph-4

Principles, objectives, and programs of the party

9. Philosophical philosophy and ideal men and guiding principles:
(a) “Sambardanism” based on eternal Vedic values, recognition and nationalism and democracy will be the ideological philosophy of RPP Nepal.
(b) RPP Nepal will honor the nation builder Shri 5 Badamaharajadhiraj Prithvi Narayan Shah as a role model and will adopt the “Divine Sermon” delivered by Shri 5 Badamaharajadhiraj Prithvi Narayan Shah as a guiding principle.

10. Purpose: The purpose of the party will be as follows:
Remaining committed to the sovereignty vested in the Nepalese people, the constitutional democracy and the prevailing constitution,
The main objectives of RPP Nepal will be as follows-
(a) To strengthen national unity by respecting and protecting the religious, social, cultural, linguistic, ethnic and class diversity existing in the Nepali society,
(b) Protecting the geographical boundaries and national integrity of Nepal by imbibing the spirit of a united Nepal,
(c) Not to allow pressure and interference of any nation in the internal affairs of Nepal and to protect national sovereignty and self-respect,
(d) Protecting and promoting the culture, traditions and values ​​of Sanatan Dharma (Hinduism, Buddhism, Kirat and Prakriti Pujan) which have been in vogue since tradition while keeping the recognition of all-religious equality and complete religious freedom intact.
(e) To have faith, trust and commitment towards the belief of Sanatan Hindu Rashtra,
(f) Adopting a liberal economic policy to raise the standard of living of every Nepali people, eliminate poverty and contribute to the overall economic development of Nepal,
(g) to ensure inclusive and proportional representation in all organs of the State;
(h) cause full observance of the principles of the rule of law;
(i) Making human rights and human values ​​the basis of state governance,
(j) Maintaining good governance in the country by maintaining zero tolerance for corruption,
(k) To expand peace and friendly relations with all countries of the world while remaining committed to non-alignment, principles of Panchsheel and the Charter of the United Nations.
(l) To end all forms of discrimination, untouchability and inequality existing in the society,
(D) To organize political activities by organizing people who are committed to the same political ideology, philosophy and program under the rule of the constitution and laws.

11. Activities to achieve the objectives: (1) RPP Nepal will conduct various activities to achieve the objectives mentioned in Article 10.
(2) To construct or rent or lease a building necessary for the party to achieve the objectives under Article 10, and to purchase or lease and use office equipment and vehicles such as computers, telephones, typewriters, faxes, etc.
(3) Appointing the necessary employees of the party and determining their terms of service.
(4) Open an account in the bank and deposit the amount received by the party in the bank and operate the bank account.
(5) To purchase immovable property as required for the operation of the party and to sell and sell the said property in accordance with the laws and regulations of the party.
(6) To publicize its policies, programs, plans or strategies or to spread propaganda on the same.
(7) Forming or causing the formation of affiliated organizations in accordance with the Constitution and the Act.
(8) To organize peaceful processions, public meetings or rallies as necessary to implement or carry out their policies, programs or plans.
(9) To promote the party’s aims and programs in order to obtain public support and cooperation.
(10) Bringing the country’s economic, social or cultural development policies, plans and programs to the public.
(11) To contribute to the development of a free and prosperous economy by making the national economy independent, independent and advanced.
(12) Enhancing the political awareness of the people as a catalyst for political or civic development.
(13) Identifying the rights, interests and concerns of citizens and the enforcement of such rights to make necessary efforts to address interests and concerns.
(14) Contribute to building an egalitarian society by ending all kinds of social discrimination, violence, untouchability or discrimination.
(15) Taking necessary initiatives in the government or non-government sector to implement the right of citizens to good governance in practice and supporting the government mechanism for that purpose.
(16) To do or cause other necessary work for the promotion, development or strengthening of democracy.
(17) To promote social harmony and unity by carrying out programs that encourage the development of voluntary spirit, promotion of sovereignty, human rights, social justice, peace and non-violence.
(18) To do other necessary work as specified to fulfill the purpose of the party.

Paragraph-5

Provisions relating to party membership, renewal fees and records

12. Type of membership: The party will have the following members:
(a) Ordinary
(b) Active
13. Eligibility required for getting membership: (1) In order to get membership of the party, the following qualifications should be met:-
(a) being a Nepali citizen,
(b) has attained the age of eighteen years,
(c) Not having been sentenced to imprisonment for corruption, extortion, human trafficking and trafficking, drug sale, distribution and export or smuggling, money laundering, kidnapping or any other criminal offense showing moral turpitude,
(d) not holding the position of professor, teacher or employee of a self-governing institution owned or controlled by the Government of Nepal, State Government or local level,
(e) Not disqualified from being a member of a political party in accordance with the constitution and law due to holding any public office.

14. Termination of Membership: (1) No person shall cease to be a member of the Party in the following cases:-
(a) If unable to obtain membership as per section 14,
(b) If the party is removed from membership after completing the procedure provided for in this By-law,
(c) if his resignation from office is accepted,
(d) in case of death,
(e) If it is proved that the party has done any act which is not to be done according to the law,
(f) If the concerned member gives written notice of resignation,
(g) If he commits or commits an act which is deemed to be defection according to the Act,
(h) on obtaining membership of another party,

15. Membership Fee: The membership fee of the party will be as follows:-
(a) Ordinary membership fee of ten (ten) rupees
(b) Active membership fee is 100 (one hundred) rupees per annum and 300 (three hundred rupees) lump sum for four years.

16. Procedure for providing membership of the party: (1) The procedure for the membership of the party for a person who has reached the qualifications according to Article 13 shall be as prescribed by the party.

17. Renewal of membership: (1) Arrangements for renewal of membership shall be as prescribed by the party.

18. Membership registration book: (1) A membership registration book will be kept in the respective municipality, district, province and center in the prescribed format so as to reveal the type of membership of each member provided by the party in accordance with this paragraph.
(2) From the date of grant of membership, the relevant municipality level committee shall maintain the record of the member in the registration book as per clause (1) within fifteen days, the district and state committee within one month and the central committee within three months.

19. Other arrangements related to oath-taking: Active members of the party have to take the oath as per schedule-4 after getting membership. In addition, elected and nominated officials and members at all levels of the party must also take oath accordingly.

20. Duties, duties and rights of members: The duties, duties and rights of members of the party shall be as follows:-
(a) Ordinary Members:
(1) To make the general public aware of the principles, ideas and programs of the party.
(2) To participate in party programs.

(b) Active Members:
(1) Be active in party work for at least 40 hours a month.
(2) To assist in the expansion of the party’s organization and influence in various classes, regions and communities.
(3) To bear the responsibilities assigned by the party.
(4) Giving necessary advice to the party.
(5) Giving regular levy to the party and assisting in fund collection.

Paragraph-6

Arrangements regarding the organizational structure of the party

21. Organizational structure: (1) The organizational structure of RPP Nepal will be of five levels as follows:
(a) Ward Level:
1. Ward convention
2. Ward Working Committee
3. Booth Committee

(b) Village and city level:
1. Village convention
2. Village Action Committee
3. Metropolitan/sub-metropolitan/city convention
4. Metropolitan/Sub-Metropolitan/City Working Committee

(d) District level:
1. District Convention
2. District Working Committee

(e) State level:
1. Provincial convention
2. State Working Committee

(f) Central Level:
1. Central Congress
2. Central Council
3. Central Working Committee
4. Central Executive Committee
(2) The central working committee of the party may make general changes in the organizational structure of the party as required without adversely affecting the structure as per sub-section (2).
(3) After the decision to modify the structure according to sub-section (3) is made, it should be submitted for approval in the general assembly held soon after.

Paragraph-7

Arrangements regarding working committee and officers

22. Central Working Committee: (1) There shall be a Central Working Committee with executive powers at the Centre.
(2) The committee under sub-section (1) shall have officers as follows.
(a) Chairman
(b) Vice President
(c) General Minister
(d) Treasurer
(d) Joint Chief Minister
(f) Spokesperson
(g) Joint Treasurer
(h) Assistant General Minister
(i) Co-spokesperson
(3) The election of the President from among the office bearers as per sub-section (2) shall be done every 5 (five) years by the Central Congress. Other officials will be nominated by the chairman from among the members of the central working committee.
(4) There will be a total of 326 members including officers in the central working committee as per sub-section (1). Among them, 60 (sixty) percent ie 192 members will be elected by the convention. Forty percent i.e. 133 people will be nominated by the president. Out of 192 to be elected, 64 will be open to women and the remaining 128 will be open to both women and men. The following “clusters” will be separated for election purposes.
a) The election of 64 women will be as follows:
Madhesi – 10
Tribal tribes – 12
Oppressed – 4
Muslim – 2
Karnali – 2
Tharu – 2
Open – 32

b) The election of the remaining 128 people will be held as follows:-
Madheshi – 14
Tribal tribes – 18
Oppressed – 4
Muslim – 4
Karnali – 2
Tharu – 2
Travel – 4
Open – 80

(5) At least one-third of the total number of members in the central working committee as per sub-section (1) shall be female members.
(6) During the election or nomination in the central working committee as per sub-section (1), the number of members shall be as determined on the basis of the principle of proportional inclusion in order to reflect the social diversity of Nepal.

23. Central Executive Committee: On the recommendation of the chairman, a central executive committee consisting of twenty-one (21) members and officers appointed by the central executive committee will be formed. The chairpersons of Disciplinary Committee, Judicial Committee, Election Committee and Audit Committee and Provincial Chairmen will be ex-officio members of the Central Executive Committee.

24. Central Secretariat: There will be a central secretariat consisting of 11 (eleven) members of the central working committee including the party president. The Secretariat will be responsible for implementing the decisions of the Central Working Committee and the Central Working Committee and for running the party.

26. Provincial Working Committee: (1) Each province will have a Provincial Working Committee with executive powers.
(2) The constitution of the Provincial Working Committee under sub-section (1) shall be as follows:
(a) There will be at least 35 (fifty) people excluding ex-officio members including Chairman-1, Vice-Chairman-3 including one woman, Secretary-1, Spokesman-1, Treasurer-1, Co-Secretary 2 and members. When calculating the number of members of the Provincial Working Committee, 35 people should be added in districts with only 8 (eight) districts and then 2/2 (two people) in each additional district.
(b) The chairman and 60 (sixty) percent members will be elected by the provincial convention from among themselves. The remaining 40 (forty) percent members will be nominated by the president from among the members of the provincial convention. The office bearers will be appointed by the chairman from among the members of the Provincial Working Committee.
(c) Central members of the party representing the respective provinces and MPs elected on behalf of the party in the relevant provincial assembly/representative assembly will be ex-officio members of the provincial working committee.
(3) The election of office bearers as per sub-section (2) shall be done every 5 (five) years by the provincial convention.
(4) At least one-third of the total number of members in the provincial working committee as per sub-section (1) shall be female members.
(5) During the election, nomination or appointment of the provincial working committee as per sub-section (1), there will be the number of members as determined on the basis of the principle of proportional inclusion in order to reflect social diversity.

27. District Working Committee: (1) Each district shall have a District Working Committee with executive powers.
(2) The district working committee as per sub-section (1) shall have the following members and officers.
(a) There will be 25 (twenty-five) to 65 (sixty-five) people ex-officio including Chairman-1, Vice-Chairman-3 including one woman, Secretary-1, Spokesperson-1, Treasurer-1, Joint Secretary-2 and members in the District Working Committee. . When calculating the number of members of the District Working Committee, 25 people should be added in the district with only 1 (one) constituency and then 6/6 (six/six) people in each additional constituency.
(b) District Working Committee Chairman and 60 (sixty) percent members will be elected by Zilla Parishad from among themselves. Wanki 40 (forty) percent members. The chairman will nominate from among the members of the Zilla Parishad. Officers will be appointed by the chairman from among the members of the district working committee.
(c) The chairpersons of the Regional Coordination Committee of the State Assembly and the House of Representatives within the respective districts will be ex-officio members.
(d) Central members of the party representing the respective districts and MPs will be ex-officio members.
(e) The chairpersons of city working committees within the district will be ex-officio members.
(f) The District Working Committee may form a District Working Committee consisting of office bearers and 9 more members to make decisions on urgent matters when the District Working Committee is not holding its meeting.
28. Provincial Assembly Constituency Coordinating Committee:
There will be the following members in the Provincial Assembly Constituency Coordinating Committee:
(a) Chairpersons of Party Village Working Committees within the State Assembly constituencies,
(b) Officials of the Party Municipal Working Committee within the respective State Assembly Constituencies,
(c) MPs elected on behalf of the party in the federal and state parliaments from within the respective state assembly constituencies,
d) Members representing the Central Working Committee, Provincial Working Committee and District Working Committee from within the respective Provincial Assembly constituencies,
(d) Elected mayors and deputy mayors of villages and cities/sub-metropolitan/metropolitan municipalities within the respective state assembly constituencies,
(f) The members of the coordination committee will elect a chairman from among themselves.
(g) The meeting of Provincial Assembly Constituency Coordination Committee shall be held at least twice a year. The meeting will discuss about the strengthening of the party organization within their constituencies, distribution of active membership, training, preparations for elections at various levels and make necessary decisions.

29. Assembly Constituency Coordinating Committee:- The Constituency Coordination Committee of the House of Representatives will consist of the following members:
(a) Chairman of the Party Village Working Committee within the respective House of Representatives Constituency,
(b) Office bearers of the party city working committee within the respective House of Representatives constituencies,
(c) MPs elected on behalf of the party in the federal and state parliaments from within the respective House of Representatives constituencies,
d) Members representing the Central Working Committee, Provincial Working Committee and District Working Committee from within the respective Provincial Assembly constituencies,
(d) Elected mayors and deputy mayors in villages and cities/sub-metropolitan/metropolitan cities within the respective House of Representatives constituencies.
(f) The members of the coordination committee will elect a chairman from among themselves.
(g) The meeting of the Constituent Assembly Constituency Coordination Committee shall be held at least twice a year. The meeting will discuss about the strengthening of the party organization within their constituencies, distribution of active membership, training, preparations for elections at various levels, and make necessary decisions.

30. Village/Municipal Working Committee: (1) Every village and municipality shall have a village and municipal working committee with executive powers.
(2) The Municipal Working Committee as per sub-section (1) shall not have officers as per below.
(a) There will be up to 31 members in the Village Working Committee consisting of Chairman-1, Vice-Chairman-3 including one woman, Secretary-1, Treasurer-1, Joint Secretary-2 and members.
(b) City Working Committee will have 21 (twenty-one) to 43 (forty-three) people depending on the number of wards including Chairman-1, Vice-Chairman-3 including one woman, Secretary-1, Treasurer-1, Joint Secretary-2 and members.
(c) The Chairman of the Village Working Committee and 60 (sixty) percent of the members shall be elected by the relevant convention, while the remaining 40 (forty) percent of the members shall be nominated by the elected chairman from among the members of the convention. The president will appoint officers from among the members of the relevant working committee.
(d) The Chairman of the City Working Committee and 60 (sixty) percent of the members shall be elected by the relevant convention, while the remaining 40 (forty) percent of the members shall be nominated by the Chairman from among the council members. The president will appoint officers from among the members of the relevant working committee.
(3) At least one-third of the total number of members in the Municipal Working Committee shall be female members.
(4) When electing, nominating or appointing the municipal working committee, the number of members will be determined based on the principle of proportional inclusion in order to reflect social diversity.
(5) Other arrangements related to village and city working committee shall be as prescribed.

31. Ward Council/Ward Working Committee:
(a) All ordinary members who have ordinary membership of the party in the wards of the rural municipality/municipality shall be members of the respective ward council.

(b) There should be at least 51 (ninety one) ordinary members in the respective ward to form a ward work committee in the rural municipality. There will be up to 15 members in the Ward Working Committee of the rural municipality including Chairman – 1, Vice Chairman – 3 including one woman, Secretary – 1, Treasurer – 1, Joint Secretary – 1 and members.
The members of the Ward Council will elect Chairman-1 and 11 members, i.e. 75 (seventy-five) percent members from among themselves. The chairman will nominate 3 people from among the council members, i.e. 25 (twenty-five) percent members. The president will appoint officers from among the members of the relevant working committee.

c) In order to form a ward work committee in the municipality, there should be at least 75 (seventy five) ordinary members in the respective ward. There will be up to 21 people in the ward working committee of the municipality including chairman – 1, vice chairman – 3 including one woman, secretary – 1, treasurer – 1, joint secretary – 1 and members.
The members of the Ward Parishad are the Chairman-1 and 15 members from among themselves, i.e. 75 (seventy-five) percent members elections will be held. The chairman will nominate 5 people from among the council members ie 25 (twenty five) percent members. The president will appoint officers from among the members of the relevant working committee.

(d) In the sub-metropolitan city, there should be at least 101 (one hundred and one) ordinary members in the respective ward to form a ward action committee. There will be up to 31 people in the sub-metropolitan ward working committee including chairman-1, vice-chairman-3 including one woman, secretary-1, treasurer-1, joint secretary-1 and members.
The members of the Ward Council will elect Chairman-1 and 23 members, i.e. 75 (seventy five) percent members from among themselves. The chairman will nominate 7 people, that is 25 (twenty-five) percent members from among the council members. The president will appoint officers from among the members of the relevant working committee.

(e) In the metropolitan city, there should be at least 151 (one hundred and one) ordinary members in the respective ward to form a ward action committee. There will be up to 41 people in the ward working committee of the municipality including chairman – 1, vice chairman – 3 including one woman, secretary – 1, treasurer – 1, joint secretary – 1 and members.
The members of the Ward Council will elect Chairman-1 and 30 members, i.e. 75 (seventy five) percent members from among themselves. The chairman will nominate 10 people from among the council members, i.e. 25 (twenty-five) percent members. The president will appoint officers from among the members of the relevant working committee.
31. 1 Booth Assembly/Booth Working Committee:
(a) There will be a booth meeting with all the members who are ordinary members of the party in the area under each booth of the village and municipality determined by the Election Commission.
(b) The village working committee will form a booth working committee consisting of at least 5 members from among the members of the booth assembly. But when there is only one booth in a ward, booth committee will not be formed, toll committees can be formed according to need.

32. Departments: (1) The party will form and mobilize departments at various levels as mentioned in this section to facilitate the operation of the party’s work and operations to all classes, communities, castes, languages ​​and regions.
(2) The following departments and committees will exist in the center:

a) Department of Organization

c) Research and Planning Department
d) Economic Department

(3) There will be a specified number of officials in the department as per sub-section (2).
(4) The Provincial Working Committee, District Working Committee, Village and Municipal Working Committees shall form departments and committees as required.
(5) There shall be a specified number of officers in the department as per sub-section (4).
(6) Departments at different levels will be formed from the working committees of the respective levels.
(7) At least one-third of the total number of members in the department shall be women members.
(8) The department shall have the number of members determined on the basis of proportional inclusion principle from inclusive groups.
(9) Other provisions regarding the department to be established in accordance with this section shall be as prescribed.

Paragraph – 8

Parliamentary Party and Parliamentary Board

33. Parliamentary Party: (1) Federal and Provincial Parliamentary Party shall be formed such that every member elected on behalf of the party in the election of the Federal Parliament or Provincial Assembly shall be a member of the Parliamentary Party.
(2) Other arrangements related to the party’s federal and provincial parliamentary parties shall be as mentioned in the statutes of the respective parliamentary parties.

34. Parliamentary Board: (1) A Parliamentary Board will be formed under the chairmanship of the party president or a central member appointed by him. The Parliamentary Board will consist of 7 (seven) members including the Chairman and
(2) The Parliamentary Board shall formulate criteria and procedures for the selection of candidates participating in the elections to the Provincial Assembly and Federal Parliament on behalf of the party. Candidates will be selected and submitted to the Central Working Committee according to the criteria and procedure as mentioned above.

Paragraph-9

Provisions relating to elections and nominations

35. Election Committee: (1) There will be an election committee as a permanent structure at the central level to complete the election of the central working committee, state working committee, district working committee, village/city, ward working committee and other committees that are required to be elected according to the law.

(2) The Central Working Committee shall form a “Central Election Committee” consisting of a Chairman, Member Secretary and nine (9) members from among the members of the Central Working Committee.
(3) According to this statute, the Central Election Committee shall be responsible for conducting the election of the working committees at various levels of the party.
(4) The Central Election Committee shall prepare and submit to the Central Working Committee the necessary rules and guidelines for the election of the party’s wards, working committees at various levels, representatives of the Central Congress and the Central Working Committee. After it is passed by the Central Working Committee, it will be the responsibility of the Central Election Committee to implement it accordingly.
(5) One third of the election committee as per sub-section (1) shall not be women members.
(6) Other arrangements related to the Election Committee shall be as prescribed.

36. Elections will be held through congresses and conventions: (1) Elections of committees at the central, provincial, and local levels will be held only through congresses and conventions of the respective levels.
(2) According to the law, if the number of women in the committee at the relevant level cannot be completed through the election, the said number will be completed from the number of nominations.

37. No-confidence motion: (1) 33 (thirty-three) percent of the members of the session of the relevant level against the chairperson of the working committee of all levels can register a no-confidence motion in the working committee of the relevant level.
(2) If the motion of no-confidence presented in accordance with sub-section (1) is passed by a two-thirds majority of all the members of the convention at the relevant level, he shall be relieved of his office.
(3) Apart from subsection (1), 33 (thirty-three) percent of the members of the working committee of the relevant level may register a motion of no confidence against the president of the relevant level.
(4) If the motion of no confidence presented in accordance with sub-section (10) or (11) is passed by a two-thirds majority of all the members of the working committee of the respective level, he shall be relieved of his office.
(5) The Vice-Chairman shall preside over the meeting called to decide on the no-confidence motion against the Chairman.
(6) Other arrangements regarding motion of no confidence shall be as prescribed.

Paragraph – 10

Provisions relating to Conventions, Conventions, and Councils

38. Conventions and Conventions: (1) The provisions regarding the conventions and conventions of the party shall be as follows:-
(a) National Convention,
(b) State convention
(c) District Convention
(d) Village/Town Convention
(e) Ward Convention
(2) The National Convention shall be the supreme body of the party
(3) The convention as per clause (a) of sub-section (1) shall be held every five years.
(4) Notwithstanding anything written elsewhere in this section, if a situation arises where the convention or convention cannot be held within the specified period due to a national calamity, epidemic or calamity, the central committee of the party in the case of the convention and the committee of the relevant level in the case of the convention of other levels shall be responsible for organizing the convention. A decision can be taken to organize the convention within the next six months at most.

39. Convention Representative: (1) The arrangement regarding the party’s national convention representative shall be as follows:-

a. Party presidents of all villages and cities/sub-metropolitan/metropolitan cities of the country,
b. Party chairpersons of all Provincial Assembly Regional Coordination Committees, Regional Coordination Committees of the House of Representatives, District Working Committees and Provincial Working Committees,
c. Convention delegates will be directly elected from the active members of the party within each House of Representative’s constituency as follows:
Women – 2, oppressed – 1, 2 from tribal / tribe / Madhesi / Tharu / Muslim / minority / backward area and 2 from others.
d) 4 people including 1 woman from each fraternal organization at the central level who have completed the central convention.
e) Maximum 25 people from affiliated organizations affiliated to the party according to the criteria set by the central working committee.
f) According to the above, 5 percent of the total number of congress representatives, persons nominated by the president from among the persons who have made special contributions to the activities of the party and who did not participate in the election due to special reasons.

40. Central Council: The Central Council of the party will have the following members:
1) Central Working Committee members,
2) Sans elected by the party to the State Assembly and the House of Representatives

3) The Party’s State Working Committee, District Working Committee and Regional Coordination Committee of the Provincial Assembly, Regional Coordinating Committee of the House of Representatives and party chairpersons of the Metropolitan Municipality, Sub-Metropolitan Municipality and Municipalities,
4) The central presidents of the people’s class organizations affiliated with the party who have completed the central convention

41. Provincial Convention:
(a) The following members will be present in the provincial convention:
1. Chairpersons of villages, towns, Provincial Assembly Election Committees, House of Representatives and District Working Committees within the respective provinces,
(2) 4 representatives, including 2 women, selected and sent by the district working committee within the respective province

42. District Convention
(a) Representatives of the following districts will be present in the district convention:
1. Chairpersons of all village working committees within the district,
2. 4 people, including women-1, oppressed-1, selected by the chairman of all city working committees within the district and sent by the city working committee.
3. Ward chairpersons of all municipalities/sub-metropolitan cities/metropolitan cities within the district,
4. 4 people including the president from each of the affiliated organizations that have completed the district convention

(b) In case of a district having only one representative assembly constituency, the formation of Zilla Parishad shall be as follows:
1. Officers and members of the Provincial Assembly Election Regional Working Committee under the district,
2. Chairpersons of all village working committees within the district, 4 people including women-1, oppressed-1, selected by the village working committee.
3. 4 people, including women-1, oppressed-1, selected by the chairman of all city working committees within the district and sent by the city working committee.
4. Ward chairpersons of all municipalities/sub-metropolitan cities/metropolitan cities within the district,
5. 4 people including the president from each of the affiliated organizations that have completed the district convention

(c) In the case of a district where there is no village working committee and there is only a city working committee, the formation of the Zilla Parishad shall be as follows:
1. Officers and members of all city working committees within the district,
2. Ward presidents of all municipalities/sub-metropolitan cities/metropolitan cities within the district and 4 people including women-1, oppressed-1 and sent by the ward working committee.
5. 4 people including the president from each of the affiliated organizations that have completed the district convention

43. Village/Town Convention:
The following representatives will be present in the village/metropolitan/sub-metropolitan/city convention:
(a) The village convention of the party with all the officers and members of the ward working committee of the village and the town convention of the party with all the officers and members of the ward working committee of the municipality/sub-metropolitan city/metropolitan city will be constituted.
(b) The village convention will elect the village working committee and the metropolitan/sub-metropolitan/city convention will elect the city working committee of the respective level.

44. Ward session:
Ordinary members within the concerned ward will be representatives of the ward convention

45. Special Conventions and Conventions: The provisions regarding the special conventions of the party shall be as follows:-
(a) If 25 (twenty-five) percent of the representatives of the convention and related level’s session request it with reasonable reasons, the president of the related level shall call a special convention and session within sixty days.

(b) In the special national convention and convention held in accordance with this article, the representatives of the convention and convention held immediately before the relevant level shall be the representatives of the special national convention and convention.

46. Functions, Duties and Powers of the Convention and Convention: (1) Functions, Duties and Powers of the Central Convention:
1) Forming various mechanisms and committees necessary for conducting the convention,
2) To elect the chairman and 60 (sixty) percent of the members of the Central Working Committee,
3) To decide on the political issues of the party,
4) To discuss and pass the report of political, economic and social policies and programs and other contemporary proposals presented by the Central Working Committee,
5) Preparing the party’s ideological concept and future strategy,
6) Giving necessary instructions after observing the overall activities of the party,
7) Revise the legislation.

47. Duties and Powers of the Central Council:
The work, duties and powers of the Central Council will be as follows:
1) The Central Council will discuss the current political, economic, social and other contemporary issues in the country and clarify the concept of the party.
2) Review the activities of the party and provide necessary guidance to the Central Working Committee.
3) During the period between one general meeting and another general meeting, apart from the election of the central working committee, the general meeting may do any work or duty if there is a need to do so.
4) If there is a situation where an immediate decision is made on a matter of national importance, he will make the necessary decision on such matter and implement it.
(5) Other provisions relating to the work, duties and powers of the Central Assembly/Council shall be as prescribed.

48. Work, duties and rights of state, district, municipality and ward sessions:
(1) Establishing various mechanisms and committees necessary for conducting the convention,
(2) Discussing the report presented by the working committee of the relevant level in the convention and preparing the next roadmap,
(3) Discussing and approving related level policies, programs and budgets,
(4) To elect the chairman and 60 (sixty) percent of the members of the working committee of the relevant level
(5) To delegate authority so that any work to be done by the convention can be done by the working committee of the relevant level,

49. Announcement of the National Convention and Convention: (1) The Central Working Committee announces the date, time and place of the National Convention.
(2) The working committee of the relevant level will announce the date, time and place where the state, district, village/city and ward sessions will be held.
(3) Notwithstanding anything written in sub-section (2), if the working committee of the relevant level does not convene or is unable to hold a session within the period required to hold a session according to the statute, the working committee of the next higher level shall call the session, specifying the date, time and place for the session of such level.
(4) According to clauses (1), (2), and (3) after the announcement of the convention and convention, the committee/committee of the relevant level will automatically be transformed into the convention and convention organizing committee.

50. Verification of decisions of national conventions and conventions: (1) For verification of decisions of central conventions and conventions of other levels, the convention/convention should form a decision verification committee consisting of 7 members, including at least one-third women, from among the convention/convention representatives.

Work, duties and rights of various levels of committees, departments and officials

51. Functions, Duties and Powers of the Central Working Committee:

7) Forming committees, departments and commissions for various purposes of the party at the central level as required and assigning tasks, duties and rights.
8) Evaluating current national and international issues and problems and finding solutions,
9) Publication of party mouthpiece,
10) Dividing the responsibilities and areas of various tasks to the central officials and members and the party’s opponents,
11) To evaluate the programs conducted by the fraternal organizations,
12) If any body of the party is found to be inactive or involved in activities contrary to the law, it should be alerted, suspended, dissolved and reconstituted as necessary.
13) Those who cause irresponsible actions to harm the interests and interests of the party and who do not follow the instructions of the party and who create divisions in the party, warn, suspend and suspend the party officials and members and working committees on the recommendation of the disciplinary committee, and if discipline is not observed even after warning or suspension, expulsion from the party. and dissolve such working committee.
14) In case of dissolution according to sub-sections 12 and 13 of Article 25 of this statute, forming an ad-hoc committee in place of the relevant working committee of the party dissolved in that way until another election is held.
15) Increase and operate the party’s fund.
16) Doing necessary work to enhance the party’s organizational strength and expand the party’s influence on the public mind.
17) According to the constitution and existing laws of Nepal, if the structure of the state, parliamentary constituencies, villages and municipalities are changed, arrange the organizational arrangements as needed.
18) Investigate the reports received from the various bodies of the party and the sister organizations of the party and give necessary instructions and take action as required.
19) To evaluate the position of the party in the elections of the parliament and local bodies and to present a report to the council or convention to be held thereafter.
20) Maintain contact and friendly relations with international organizations and do necessary work to promote mutual interests.
21) Appointing an auditor to make the financial management of all levels of the party clear, transparent and regular.
22) To nominate specific persons who have made significant contributions to the party or who can fulfill them as senior leaders, senior members and other honorary positions,
23) To do all the necessary actions for strengthening the party.
24) Making policy decisions regarding whether to participate in the party government or not and whether to support someone or not. To determine the criteria for the ministers who will participate in the government.
2) Other arrangements related to the work, duties and rights of the Central Working Committee shall be as prescribed.

52. Functions, Duties and Powers of the Central Executive Committee:
(1) Functions, duties and powers of the Central Executive Committee:
(a) To do the work to be done by the Central Working Committee during the period when the Central Working Committee is not meeting,
b) To implement and monitor the decisions of the Central Working Committee,
c) Decisions made by the Central Working Committee must be approved by the Central Working Committee.
d) Reviewing the activities of the Central Department and giving necessary instructions,
(e) The meeting of the executive committee will be held at least once a month.
(2) Other arrangements regarding the work, duties and powers of the Central Performance Committee shall be as prescribed.

53. Work, Duties and Powers of Provincial Working Committee:
(1) The work, duties and powers of the Provincial Working Committee shall be as follows:-

(a) To complete the formation of the party’s ward, Davis, municipality, constituencies and district level units within the respective provinces and keep them continuously active.
(b) Organizing provincial-level programs.
(c) To always carry out the programs determined by the Central Working Committee with readiness,
(d) Monitoring, supervising, supporting district-level programs,
(e) To play a leading role in resolving the disputes of all the bodies of the districts assigned to him within his province,
(f) Periodically visit his province and be active in strengthening the party,
(g) To recommend to the Central Committee for disciplinary action if it is felt that any agency or official or member within the province has violated the code of conduct of the party, as necessary,
(h) To coordinate and cooperate with the district in the selection process of candidates in all types of elections in which the party participates and recommends to the center.
(i) Other a perform
(j) Office: The office of the provincial working committee will be in the capital of the province. The central committee will remain in the place until the capital is designated.
(k) The provincial executive committee may form a provincial executive committee consisting of office bearers and 9 more members to make decisions on urgent matters when the provincial executive committee is not holding its meeting.

(2) Other provisions regarding the work, duties and rights of the Provincial Committee/Committee shall be as prescribed.

54. Work, duties and rights of the local level working committee:
(1) The work, duties and rights of the working committees of the various levels of the party from the ward to the district level will be as follows:
a) To follow the policies, principles, programs and instructions of the party,
b) Helping to solve people’s daily problems,
c) Providing leadership for programs that benefit the people and conducting such programs,
d) Conducting programs against various local problems including partiality, injustice, tyranny, oppression,
e) To prepare a group of disciplined and diligent workers towards the party.
f) To promote mutual cooperation, coordination and harmony between elected party members and organized organizations in local bodies at their respective levels.
g) Always be active in making effective contributions to strengthen the party organization.
h) To raise voice in matters of political, economic, social, educational, commercial, peace security and development and concerns of the people and take initiatives to solve those problems.
j) Conducting meetings, conferences, seminars, conferences, trainings, etc.
j) Continuously be active in enhancing the membership of the party, renewing the membership, recommending for active membership.
k) To keep the records of the workers in a regular manner.
f) According to the political and geographical conditions and needs of the district, the district working committee may form a party area coordination committee with a maximum of 9 members in the designated areas for the purpose of forming the district development committee for political mobilization.
d) To suspend such party members if they act against the interests of the party, cause a split within the party, disturb the party unity, violate the party decision and become a candidate against the official candidate of the party, become a supporter or proposer and spread the propaganda of such candidate and so on. Recommend to the working committee and disciplinary committee one level above to take disciplinary action on the members.
D) District Working Committee shall constitute a 3-member Disciplinary Committee to recommend disciplinary action against district and subordinate party workers at the district level.
(h) Forming election committees at different levels under the instructions of the Central Election Committee to complete the elections at their respective levels
i) To hold regular meetings, to follow and implement the decisions and policy directives of the center and the provinces from time to time, and to carry out other tasks deemed necessary by the working committee.
Th) When choosing representatives from the local level to other higher levels and to the convention, the respective councils will choose by following the election process.
D) At least one month before the local level election, the relevant working committee will recommend the list of candidates to the upper level. The recommendation made by the lower level should be decided by the working committee one level higher and sent to the higher body for approval.
d) Assisting in the protection of local, religious, cultural, archaeological and historical heritage.
N) Mobilizing the party by actively participating in development and public welfare activities in their area.
C) Work in coordination with elected officials in local bodies on behalf of the party.
f) If the different wards of the same municipality fall within different constituencies, the wards shall work in coordination with the respective constituency work committee and the city work committee with the district work committee.
(2) Other arrangements related to the work, duties and rights of the local level working committee shall be as prescribed.

55. Functions, duties and rights of the officers of the Central Working Committee:
(1) The duties, duties and powers of the Chairman shall be as follows:-
(a) Upholding and upholding the ideals, principles and dignity of the party;
(b) To provide effective leadership to run the party as a strong and capable organization.
(c) To preside over the meetings of the Party’s Central Congress, Central Council and Central Working Committee and Central Working Committee,
(d) To give instructions to the relevant officials, members, committees and bodies to maintain discipline within the party and if necessary submit to the Central Working Committee to take action,
(e) If it is found that any agency or official of the party is inactive or is involved in illegal activities, has acted irresponsibly against the principles and interests of the party, has not followed the instructions of the party, has acted to create division in the party, to warn such agency or official, to suspend, warn or if there is no improvement even after suspension, submit it to the central working committee for necessary action along with the recommendation of the disciplinary committee,
(f) Until the next election, forming an ad hoc committee in place of the party body dissolved in that manner according to the decision of the Central Working Committee.
(g) Allocating the work of various committees and officials at the central level of the party, monitoring the work progress and giving necessary instructions,
(h) The President deems the persons who have made significant contributions to the party or who can contribute to the Central Working Committee necessary for the Central Committee 15 (fifteen) percent of its total members may nominate invited central members.

(2) The duties, duties and powers of the Vice-President shall be as follows:-
(a) Conducting the work of the Chairman in his absence.
(b) Perform other duties as assigned by the President and the Party

(3) The functions, duties and powers of the General Minister shall be as follows:-
(a) It shall be the duty of the General Minister to carry out the daily work of the party, to call the meeting of the working committee according to the order of the chairman and to do the work assigned by the chairman from time to time.
(b) It will be the responsibility of the Chief Minister to implement the decisions of the committee.
(c) The General Minister will present the report of the party in the congress, council and committee meetings.
(d) The General Minister will be responsible for running the office.
(e) The General Minister shall be responsible for keeping all types of records of the party safe.

(4) The functions, duties and powers of the Treasurer shall be as follows:-
(a) The treasurer shall be responsible for the funds of the party.
(b) To keep a statement of all the income and expenditure of the party and to have the accounts checked by the auditor and to keep the accounts correct and
(d) To collect regular levies from the members of the central working committee of the party,
(e) To collect levies regularly as prescribed by the Central Committee from various levels of persons elected or nominated or appointed after obtaining approval from the party,
(f) Keeping records of the party’s material assets and safeguarding them
(g) Conducting various programs to increase the funds of the party,
(h) To give necessary policy instructions to state and local level party bodies to maintain income-expenditure balance,
(j) To submit a financial report with details of income and expenditure in the meeting of the National Working Committee

(5) The work, duties and powers of the Deputy General Minister shall be as follows:-
(a) In the absence of the General Minister, perform the tasks delegated by the General Minister.
(b) To carry out tasks assigned by the General Minister with authority.
(c) To supervise and control the management of the central office of the party.
(d) To do all the work assigned by the party.

(6) The work, duties and powers of the spokesperson shall be as follows:- To put the party’s point of view on various contemporary and political issues officially before the public through the media.

(7) The functions, duties and powers of the Joint Treasurer shall be as follows:-
(a) Acting as Treasurer in the absence of the Treasurer.
(b) The Treasurer has given the authority to do the assigned work.
(c) To do other work imposed by the party.

(8) The duties, duties and powers of the Assistant General Minister shall be as follows:-
a) In the absence of the Deputy General Minister, perform the tasks delegated by the Deputy General Minister.
b) To do all the work assigned by the party.

(9) The duties, duties and powers of the Joint Spokesperson shall be as follows:-

(a) To do the work done by the spokesperson in the absence of the spokesperson.
(b) Spokesperson will do the assigned work with authority.
(c) To do the work imposed by the party.

56. Work, duties and rights of local level and provincial working committee officials:
(1) The duties, duties and powers of the Chairman shall be as follows:-

To preside over the meeting of the working committee and convention of the relevant level.
To expand the Party’s organization and influence within its sphere of activity.
Participating on behalf of the party in various organizations or sending representatives.
To maintain discipline among the workers at the relevant level and to take action according to this law.
To lead the relevant level.
Do other tasks assigned by the working committee.
(2) The duties, duties and powers of the Vice-President shall be as follows:-

Acting as the President in the absence of the President.
To do other tasks assigned by the chairman and working committee.
(3) The functions, duties and powers of the Secretary shall be as follows:- The decisions made by the working committee of the relevant level will be implemented under the guidance of the chairman.
Keeping records of meetings.
To do other tasks assigned by the working committee.
Conducting programs organized by the party.
(4) The functions, duties and powers of the Treasurer shall be as follows:- To manage and operate the funds of the relevant level under the guidance of the chairman. To do the necessary work to increase the fund.
Keeping income and expenditure account and submitting income and expenditure report every three months to the meeting of the relevant level.
(5) Other arrangements related to the work, duties and rights of officials shall be as prescribed.

Paragraph-12

Arrangements regarding meetings and decisions

57. Provisions regarding meetings and decisions:
Arrangements related to meetings and decisions will be as follows:

1) Meetings of working committees, conventions, and councils of different levels will be chaired by the president of the respective level.
(2) The meeting of the Central Working Committee shall be held at least 1 (one) time in 3 (three) months and the meeting of the working committee of other levels shall normally be held 1 (one) time in a month.
(3) The meeting of the Central Council shall be held at least once a year. However, the meeting of the Central Council will not be held in the year of the Central Convention.
4) The decisions of the meeting made by the working committee of all levels should be certified by the president of the respective level. The record of the meeting should be kept by the Chief Minister or the Secretary.
(5) The decisions of the meeting should be sent to the body 1 (one) level above the party as soon as possible.
(6) Meetings of working committees at different levels will be called by the Chief Minister or the Secretary as per the order of the Chairman.
(7) If requested in writing by one-third of the members of the working committee, convention, central council, and central convention of any level, the chairman shall call the meeting of the relevant level.
(8) The person presiding over the meeting of the relevant level shall not have the right to vote. When deciding the meeting, only if the number of votes is equal, the person presiding over the meeting will have the casting vote.
(9) In the meeting, the decision made by the majority of the working committee will be considered, if not satisfied, any member can record a different opinion in writing.

Paragraph-13

Disciplinary Actions and Appeals

58. Disciplinary Committee:
(1) The Central Working Committee shall constitute a Central Disciplinary Committee of 7 (seven) members including the Chairman from among the members of the Central Working Committee.
(2) The Disciplinary Committee shall make recommendations to the Central Working Committee for action in the case of violation of the party’s code of conduct by any party’s officials and members at any level.
(3) The Central Disciplinary Committee may delegate its authority to provincial and local level committees.

59. Code of Conduct:
(1) The Central Working Committee shall formulate and implement a code of conduct to be followed by the officers and members at all levels.
(3) It shall be the duty of every officer at all levels and all other members to comply with the code of conduct as per sub-section (2).
(4) Other provisions related to the code of conduct shall be as prescribed.

Paragraph – 14

Party Funding Arrangements

60. Fund: (1) There shall be a separate fund at all levels of the party in which the following funds shall be deposited:-
(a) Amount received for membership fees
(b) amount received by way of prescribed levy or membership renewal fee,
(c) amount received from clean financial support to the party,
(d) the amount collected by the party by organizing any event,
(e) Proceeds from publication and sale of movable immovable property,
(f) interest amount received from the bank for the amount in the fund,
(g) amount received for assistance,
(h) Any amount received by the party in accordance with the law.

(2) The amount in the fund according to sub-section (1) shall be deposited by each level committee by opening an account in the bank.
(3) Other arrangements related to the fund shall be as prescribed.

61. Bank Account Operation:
(1) The bank account of the party shall be operated with the signature of any two persons from among the chairman, general minister/secretary and treasurer of the working committee of the relevant level.
(2) Other arrangements related to the operation of the party’s bank account shall be as prescribed.

62. Audit Committee: (1) The Central Working Committee shall constitute a Central Audit Committee of 7 (seven) members including the Chairman from among the members of the Central Working Committee.
(2) The work, duties and powers of the Accounts Committee shall be as follows:-
(a) to examine the accounts of the various levels of the party;
(b) To issue instructions for immediate correction if it is found to be satisfactory during the audit of the accounts as per clause (a),
(c) arranging for internal audit;
(e) to manage data and records of movable and immovable assets of the party,
(3) Other arrangements related to the Audit Committee shall be as prescribed.

63. Public audit report: (1) Submission of the party’s audit report to the Central Working Committee and to the Election Commission as provided by law.
(2) Other provisions related to public audit shall be as prescribed.

64. Other arrangements related to funds and financial management: (1) Records shall be kept in such a way that clear details of the party’s land, buildings, vehicles, machine tools, furniture fixtures and other assets are disclosed.
(2) The details of the records kept as per sub-section (1) shall be submitted to the Central Working Committee within the middle of Chaitra every year.
(3) Other arrangements related to party fund and accounting management shall be as prescribed.

Chapter-15

Legislative amendment

65. Procedure for amendment of the constitution: (1) Amendment of the constitution of the party shall be done only by the convention.
(2) Notwithstanding anything contained in sub-section (1), the Central Working Committee may amend the Bye-Laws until the cfufdL Mahadiveshanaf6 cg’df]bg.
(3) Other provisions related to the legislative amendment process shall be as prescribed.

66. Term of office: (1) The term of office of the central working committee and the provincial working committee and the committees and departments at the central and provincial levels will be five years.
(2) The term of office of committees and departments at the district and village/city level will be three years.
(3) The term of office of the committee, department, at the ward level will be one year.

67. Can resign from the position: (1) The president can resign before the working committee of the relevant level and other members and officials can resign before the president.
(2) The resignation registered according to sub-section (1) shall be accepted by the decision of the majority of the total number of members of the working committee of the relevant level.

68. The position of office bearers and members shall be vacant: The position of office bearers shall be vacant in the following cases:-
(a) on his death,
(b) if his resignation from his office is accepted,
(c) if he deserts the party,
(d) if a motion of no confidence is passed against him,
(e) In case of disciplinary action.

69. Vacancy filling: (1) If the term of the elected chairman or member becomes vacant, it will be done through the meeting of the working committee of the relevant level.
(2) The procedure related to cohabitation shall be as prescribed.

(3) In the case of nominated members and office bearers, the appointment shall be made by the body or office bearer from which they were nominated.

70. Staff Management: (1) The party can determine the facilities of staff recruitment and service conditions of the staff as required.
(4) Other arrangements related to staff recruitment and service facility conditions shall be as specified in the Staff Administration Regulations.

71. Provisions related to property details: The person elected as an officer and member of the party’s central committee must submit the details of his movable and immovable property to the party’s central office within sixty days of being elected.

72. Delegation of Authority: The working committee of the relevant level can delegate its authority to any department, committee or officer of the relevant level.

73. Interpretation of the Constitution: The final interpretation of the Constitution will be done by the party convention.

74. Removal of obstacles: (1) If any obstacles are encountered during the implementation of the law, the central working committee of the party will decide to remove the obstacles.
(2) If necessary amendments are to be made to the statutes in accordance with the decision made in accordance with sub-section (1), the proposal for the amendment of the statutes shall be submitted to the general assembly held immediately after completion of the procedure as per the statutes.
(3) Procedures for clearing obstructions and other arrangements related to clearing obstructions shall be as prescribed.

75. Transitional arrangement: (1) After the announcement of the convention or convention by the committee at the relevant level, the existing committee will be transformed into the convention or convention organizing committee.
(2) The committee that has been converted according to sub-section (1) shall act as the executive committee of the relevant level until another committee is elected by the convention or convention.

76. Can make regulations: The central committee of the party can make regulations and procedures as necessary to implement the provisions of this constitution.

77. Affiliated Organizations:
1) The party will recognize various class and business organizations that have faith in the party’s objectives as affiliated organizations.
2) Generally, only one organization in a category or business will be recognized. In this way, the recognized organization has to support the party and follow the general instructions of the party.
3) The Central Working Committee of the Party may dissolve the joint organization that acts contrary to the principles, policies, and programs of the Party, does not follow the instructions of the Central Working Committee of the Party and forms an ad hoc committee in its place.
78. Quorum: The quorum for the meetings of the Central Congress, Central Council, and other level councils shall be one-third of the total number of members. The quorum of various working committees will be 51 percent.
